l THE WITNESS: Here it is.

MR. MOORE: For the sake of completeness, I'm going

to offer this document into evidence as well.

MS. ROMANO: No objection, your Honor.

THE COURT: It will be received. That will be

defense next in order.

MR. MOORE: Before I rest with Mr. Canada, I don't

know if it's the appropriate time, I would like to review at

some point before the close of evidence the status of

documents that have been introduced into evidence in case I

need to complete any foundational requirements with

Mr. Canada.

THE COURT: Tina can you tell me which ones have

been admitted so far?

THE CLERK: We have 1, 2 and 3 with defendant's and

we have 4 as plaintiff's.

THE COURT: 1, 2, 3 and 4 have been admitted.

MR. MOORE: Do we know what those are?

THE CLERK: 1 is a letter regarding the medical

marijuana use dated January 1st of '04. 2 was a letter

regarding medical marijuana use dated June 16th of '04. 3 is

the letter that was placed on his door with the yellow sticky

on it and 4 is the letter from Department of Fair Employment

and Housing dated 4/30/04.

MR. MOORE: Thank you very Much. I don't know how

you handle it. I understand that you've ruled evidentiary

that I cannot introduce my videotape, but I do want to have

that with the Court.
